The publication raises the following questions: (1) Does federalism now reign supreme, effectively gutting the Tenth Amendment? (2) Was Lopez an anomaly, leaving the Tenth Amendment alive and well? Or (3), has America, via U.S. v. Lopez, reached (or merely solidified) a blended approach where both federalism and the Tenth Amendment must peacefully co-exist to protect the rights of U.S. Citizens? The authors flatly reject (1), and provide evidence supporting (2) and (3), suggestion that, perhaps, James Madison (Federalist 45) was correct after all in asserting that the Revolutionary War was fought to protect the people, not the states.
